2. A. Informational Report on Potential Ballot Measure Amending the Open Space Initiative
of 2002 to Redesignate Portion of O’Keefe Property from the Open Space Preserve

The City Attorney will present proposed language for a possible citizen's ballot initiative in 2026 to allow the City Council to remove the O'Keefe land from Open Space in the event that is deemed necessary to avoid a Builder's Remedy declaration.

Removing O'Keefe from Open Space requires a vote of the citizens in town.

If the proposed measure is approved as a citizen's initiative, qualifies for the ballot, and is approved by a majority of voters, the City Council would have the ability to remove the O'Keefe property from Open Space if deemed necessary to avoid the imposition of Builder's Remedy.
In the event of a Net Loss event, the town could be required to identify alternate viable sites in as little as 30 days. This measure would allow the Council to respond to such situations expeditiously to avoid a Builder's Remedy.
