ITEM 2. PUBLIC HEARING

A. Adopt Resolutions making findings and deny two applications to construct multi-family
senior residential developments on vacant parcels at 10728 and 10758 Mora Drive,
respectively (File Nos. CDPD23-0001 and 0002) pursuant to Government Code Section

From the Staff Report:
On February 1, 2023, Forrest Linebarger (“Applicant”) submitted two preliminary applications and
formal applications (File Nos. CDP23-0001 and CDP23-0002) under Government Code sections
65941.1 and 65589.5 for multi-family senior residential buildings located on 10728 and 10758 Mora
Drive, Los Altos Hills. These applications were submitted pursuant to Government Code section
65589.5(d), commonly known as the “Builder’s Remedy” (the “BR Project(s)”). Between April and
November 2023, the BR Projects were revised to increase the number of units and to include other
interior revisions. The BR Project applications were processed and reviewed by the Town and also
routed to the Santa Clara County Fire Department (Santa Clara County Central Fire Protection
District’s fire department; referred to as “SCCFD” or “Fire Department”) for review.
On January 30, 2025, the City Council scheduled a public hearing to consider adoption of findings
for denial of the BR Projects in accordance with Government Code section 65589.5(d), based on
the results of project reviews. On the same day of and a few hours before the public hearing, the
Applicant submitted revised Project plans and documents to the Town. In response, the City Council
opened the public hearing but continued the hearing to March 20, 2025. The Applicant subsequently
submitted another set of revised plans and supporting documentation on February 25, 2025, which
necessitated further review by the Town. Consequently, the City Council continued the matter to a
date uncertain at the March 20, 2025 hearing. On May 29, 20251, the Applicant submitted further
revised Project plans and documents. Upon review of those revised submittals, the public hearing
was then scheduled for June 18, 2025.
